By now, I think most people know that our entire legal challenge was dismissed in Superior Court. We have 11 expert reports, none of which were challenged by the government. We have 9 questions of constitutional law, only 2 of which were countered by the government. Yet, not a single thing was heard today. No jurisdiction, said the judge.

This begs the question: if a Superior Court justice doesn't have the jurisdiction to hear a constitutional challenge... who does??

What experts? What evidence? What Charter? They don't exist, according to this judge.

What happened was a complete joke. If the government found a defect in our challenge, they could have brought a motion to strike, which would have been the correct action. Absent that, the judge could have adjourned the proceeding to allow us to do what the government and court wanted. But that would've been logical, reasonable, fair and just. Can't have that.

The ONLY limitations to a Notice of Constitutional Question are 15 days of notice, in the proper form, with a sufficient evidentiary record. The Supreme Court has weighed in on this many, many times. I know all the cases off the top of my head. Dunedin in 2000, Doucet-Boudreau v. Nova Scotia in 2003, Vancouver v. Ward in 2010, Guindon v. Canada in 2015 and Ernst v. Alberta Energy Regulator in 2017.

The Superior Courts in this country have the broadest jurisdiction and maximum power and authority to hear every civil proceeding, especially constitutional proceedings. In a free and democratic society under British Common Law, one is subject to natural justice and fundamental justice. Simply put, one has the right to be heard. And that right was denied to Adam. Access to justice was denied.

This is the first time a Notice of Constitutional Question served and filed months in advance with a huge evidentiary record was refused to be heard in a Superior Court in Canadian history. The rule of law has been cancelled, once again.

If we had done this like the government and court wanted, then the injunction would have lapsed and another proceeding would have been brought... only for us to be told it's res judicata (Latin for "already judged") and we are trying to re-litigate the matter.

Damned if you do. Damned if you don't.

We have a slam dunk, prima facie, open and shut case. The government hasn't touched any of our evidence with a 40 foot pole and has minimally addressed a couple of our arguments, while ignoring the rest.

We will see this through to the Court of Appeal and are prepared to take this all the way to the Supreme Court. The evidence and the law are stacked in our favour. Please share our 11 expert reports worldwide and speak out.

We do not consent. We will not comply. We will not obey. WE WILL NEVER GIVE IN.

The Hearing Day has Finally Arrived!

The evidence that led me to oppose the government mandates has been fortified over the last few months. Since November, the issues with the PCR test and the data around asymptomatic transmission, ICU admissions and mortality has been solidified through Freedom of Information Requests and in international court rulings. The evidence on this Constitutional Challenge is absolutely STACKED in our favour. So much so, that the Crown Attorneys have abandoned all scientific arguments.

Other jurisdictions around the country have seen narrower challenges fail, where the applicants have holes in the evidentiary record. For instance, a federal challenge brought by the JCCF recently failed because while PCR was exposed, "VOC's" were not, and the judge had no choice but to rule for the government. Not so on our challenge- we have them surrounded.

Check this out- the Crown thinks the reports brought by six well-qualified experts are "superfluous" and "vexatious". What is this, China? The Soviet Union? With their literally infinite resources, they couldn't find any experts to rebut our arguments? We don't have standing to bring a challenge this strong because... It's annoying?

"In their factum, the Respondents seek to impugn the entirety of Ontario’s response to the COVID-19 pandemic. The actual scope of this proceeding is much more limited. (...) All of the Respondents’ many and far-fetched grievances about vaccines, PCR testing, hydroxychloroquine, stay-at-home orders, purported cost-benefit calculations, herd immunity, and the World Health Organization – among many other such topics – are superfluous to this proceeding; indeed, they are vexatious. (...) While the Respondents are entitled to their opinions, their “disdain for the legislation [is not] a sufficient direct interest to meet the test for the granting of standing to challenge in this proceeding the validity of the entire provincial legislative response to the COVID-19 pandemic."

THE EVIDENCIARY RECORD IS STACKED IN OUR FAVOUR.

We brought 11 expert reports, the Crown brought 1.

We made 5 charter arguments, the Crown responded to 1.

We made use of every page of factum allowance, the crown left 15 pages empty.

It's clear that the Crown will rely on procedural BS or a biased judge for a favourable ruling.

In totally unrelated news, we had a judge switcheroo midway through this challenge! We were told it was a scheduling issue, before we got to schedule anything. Later we received an email showing it was an administrative issue. Coincidence, I'm sure!

My lawyers tell me that the courts tend to rule with public opinion. While the tides are turning, the media won't report any counter-narrative, so much of the public consciousness in Canada is still blanketed by fear. I've done the best I can to disseminate this information, the rest is up to us on the big day.

There is a rally tomorrow at 10am at Nathan Phillips Square to make our presence felt. You can attend the ZOOM hearing so the judiciary can see how many eyes are watching this case. You can share this information with your friends, and be comforted knowing that the TRUTH and SCIENCE is on our side.

The government-funded media outlets WILL NOT REPORT on this challenge, despite taking every opportunity to cover my arrest, my licensing issues, and the endless fines and charges I received. How messed up is that?

The Adamson Barbecue constitutional challenge is well underway. Cross-examinations of experts have concluded, factum submitted, and we're scheduled for a hearing on June 28th and 29th.

This challenge has little to do with the restaurant. It is a constitutional question of the Reopening Ontario Act, and the evidence (or lack thereof) used to justify it. The ruling of this case will effect everyone living in Ontario, and will set precedent for legal challenges across the country. If this challenge is successful, entrepreneurs can reopen their restaurants, bars, gyms and salons, children can go back to school, and everyone can gather together to celebrate, mourn and worship.

The evidence that I used to justify re-opening my restaurant back in November has been further validated over the last six months. This challenge, supported by six experts, absolutely shreds the mainstream narrative of “a deadly pandemic which warrants stay-at-home orders, business and school closures, social distancing measures and mask mandates”.

Our experts have brought to light the invalidity of the PCR test, the lack of cost-benefit analysis on masks and lockdowns performed by the government, the brutal economic and public health damages caused by lockdowns, the province’s ignorance of reasonable alternative treatments, the insignificance of asymptomatic transmission, and the statistics around ICU admissions and mortality.

The province has called one lone expert, a hired gun, a consultant for legal challenges. Dr. Hodges from U of T has been immersed in work for, you guessed it, the WHO and UN over his career.
